ATOMソフトウェア利用規約

対象製品:ATOM(アトム)のために富士ソフト株式会社が提供する一切のソフトウェア

重要:本ソフトウェア利用規約(以下「本契約書」といいます)は、頭書に示されたソフトウェア(以下「本ソフトウェア」といいます)に関してお客様(以下「甲」といいます)と富士ソフト株式会社(以下「乙」といいます)との間に締結される契約書です。本ソフトウェアは、これに関連した媒体、印刷物(マニュアルなどの文書)、電子文書、およびインターネットを通じて提供される乙のサービスを含みます。本ソフトウェアには、本契約書の修正または追加条項が付属している場合があります。なお本ソフトウェアを使用(ATOM(アトム)本体を起動することを指します)、ダウンロード、インストール、または開封することによって、甲は本契約書の条項に拘束されることを承諾したものとみなします。また本契約書の条項のいずれかに同意されない場合、乙は甲に対して、本ソフトウェアの使用、ダウンロード、インストール、または開封のいずれも許諾することはできません。

なお、ATOM(アトム)本体には、以下のフリーソフトウェアコンポーネントが組み込まれています。

  1. ・Linux kernel 4.1.15
  2. ・OpenCV
  3. ・POCO
  4. ・MeCab
  5. ・Julius
  6. ・xmlrpc++ (乙改変)
  7. ・Mozilla Firefox 4.5.9

これらのソフトウェアコンポーネントは「本ソフトウェア」には含まれず、下記ソフトウェア使用許諾契約書の対象とはなりませんのでご注意ください。また、これらのソフトウェアコンポーネントの使用許諾条件については、後述の各々についてのお知らせをご覧下さい。

第1条 (許諾される権利)

甲が本契約書のすべての条項および条件を厳守する限り、乙は、甲に以下の非独占的な権利を許諾します。
甲は、本ソフトウェアをATOM(アトム)本体にインストールして使用、アクセス、表示することができます(予め乙によりATOM(アトム)本体へインストールされているものを含みます)。

第2条 (追加のソフトウェア/サービス)

甲乙間で別途特段の定めがない限り、本契約書が、本ソフトウェアの最初のセットアップによって提供され、また使用可能になる本ソフトウェアのアップデート、機能追加、アドオンコンポーネントおよび乙によりインターネットを通じて提供されるサービスコンポーネントに対しても、それらに他の条項が付属していない場合に限り本契約書が適用されます。本ソフトウェアの使用により甲に提供され、またはインターネットを通じて提供されるサービスを開始または中止する権利は、乙によって留保されます。

第3条 (制限事項)

甲は、乙が事前に書面にて承諾した場合を除き、以下の制限事項を厳守しなければなりません。

  1. (1)複製の禁止
    甲は、本ソフトウェアのインストールによるものおよびバックアップを目的としたものを除き、本ソフトウェアを複製することはできません。
  2. (2)リバースエンジニアリング、逆コンパイル、逆アセンブルの禁止
    甲は、本ソフトウェアをリバースエンジニアリング、逆コンパイル、または逆アセンブルすることはできません。
  3. (3)第三者への譲渡の禁止
    甲は、本ソフトウェアを第三者に譲渡することはできません。
  4. (4)レンタル等の禁止
    甲は、第三者に本ソフトウェアをレンタル、リース、第三者に配布、再使用許諾または貸与したり、本ソフトウェアを使用して商業的サービスを提供することはできません。
  5. (5)海外での使用・海外への持ち出し禁止
    本ソフトウェアの使用は日本国内に限られ、甲は本ソフトウェアを日本国外で使用することはできません。また、甲は、本ソフトウェアを日本国外に持ち出すことはできません。
第4条 (検査)

甲は、本ソフトウェア受領後直ちにその物理的障害の有無について検査を行うものとします。物理的な媒体を介さず本ソフトウェアを受領した場合には、受領後直ちにセットアップを行い、セットアップ中の障害の有無について検査を行うものとします。当該検査の結果、本ソフトウェアに物理的障害もしくはセットアップ中の障害があった場合、甲は直ちに乙に通知するものとし、その対応について乙の指示に従うものとします。

第5条 (著作権等)

本ソフトウェアは、著作権法ならびにその他の知的財産権に関する法律によって保護されており、乙(またはその供給者)は、本ソフトウェアに関する権原、著作権、およびその他の知的財産権を有しています。乙は甲に対して、本契約書第1条に定める権利に限定して許諾するものとします。なお、本契約書に明示的に規定されていないすべての権利は、乙(またはその供給者)によって留保されます。また甲は、本ソフトウェアおよびそのバックアップに含まれる本ソフトウェアの著作権表示を変更または削除してはなりません。

第6条 (その他の権利および免責)
  1. (1)データの使用に関する承諾
    甲は、乙およびその関連会社が、本ソフトウェアに関連した製品サポートサービス(該当する場合)の一部として集めた技術情報を収集して使用することを承諾するものとします。乙は製品の品質向上のため、また甲にカスタマイズされたサービスもしくは技術を提供するためにのみ、この技術情報を使用することがあります。ただし、甲を特定することとなるような方法で技術情報を開示しないものとします。
  2. (2)アップデート機能
    甲が本ソフトウェア内のアップデート機能(該当する場合)を利用する場合は、その機能を使用するために甲の特定のコンピュータシステム、ハードウェア、およびソフトウェア情報を使用する必要があります。これらの機能を使用することにより、甲は、乙またはその指定代理人に、アップデートのために必要な情報にアクセスしてその情報を利用する権限を明示的に与えるものとします。乙は製品の品質向上のため、また甲にカスタマイズされたサービスもしくは技術を提供するためにのみ特段の許可を得ることなく、この情報を使用することがあります。ただし、甲を特定することとなるような方法で情報を開示しないものとします。
  3. (3)使用用途
    本ソフトウェアは一般事務用、パーソナル用、家庭用などの一般的用途を想定して設計されたものであり、航空交通管制、大量輸送運行制御など、きわめて高度な安全性が要求され、仮に当該安全性が確保されない場合、直接生命・身体に対する重大な危険性を伴う用途(以下「ハイセイフティ用途」といいます)に使用されるよう設計されたものではありません。また、甲が当該ハイセイフティ用途に本ソフトウェアを使用したことにより発生した損害に対して乙は一切の責任を負いません。
  4. (4)セキュリティ対策
    本ソフトウェアにおけるセキュリティ対策は、本ソフトウェアが発表された時点の水準によるものです。なお、現実に生じた不正アクセス・ウィルス攻撃等に対する防御は、甲の実施事項となります。
第7条 (保証)

以下は甲に適用される明示の品質保証規定(以下「本保証規定」といいます)です。

  1. (1)本保証規定は本ソフトウェアにおける意思表示、またはその他の意思表示に記載されるその他の明示的保証(該当する場合)に代替するものです。
  2. (2)本ソフトウェアの瑕疵に対しては、その対応につき乙の判断に委ねることとします。
  3. (3)本製品の使用により生じるサポートまたはその他のサービス、情報、ソフトウェア、および関連コンテンツの提供もしくは提供不能に関して、本保証規定に規定されていない保証を、明示、黙示、若しくは法律上のものであることを問わず一切いたしません。
  4. (4)本ソフトウェアに関する権原は乙に帰属していること、表示との一致または第三者の権利侵害の不存在等についての保証を一切いたしません。
第8条 (製品サポート)
  1. (1)本ソフトウェアのサポートサービス(該当する場合)は別途契約を締結させていただきます。
  2. (2)本ソフトウェアは事前通知なく製造、販売および配布を終了することがあります。その場合、前項で規定するサポート契約の新規締結および継続は行わないものとします。
  3. (3)前項(2)の終了に伴い、本契約も全部または一部を終了します。ただし、第5条、第6条(1)(4)、第7条(4)、第9条、第12条、第13条、第14条および本条の規定は、契約終了後も有効とします。
第9条 (責任および救済手段の制限))

いかなる事由における損害も、本契約書に基づき乙およびその供給者の損害賠償責任(乙によって選択された修理または交換による対応を除きます)は、甲がATOM(アトム)を購入時、実際に支払った金額を上限とします。

第10条 (本規約の変更)

乙は、乙が必要と判断する場合、予め甲に通知することなく、いつでも、本契約書を変更できるものとします。変更後の本契約書は、乙が運営するウェブサイト内の適宜の場所に掲示された時点からその効力を生じるものとします。本ソフトウェアをご利用の際には、随時、最新の本契約書をご参照ください。

第11条 (契約の終了)
  1. (1)甲が本契約書の条項または条件に違反した場合、乙は、他の権利を害することなく本契約書を終了することができます。
  2. (2)前項により本契約が終了した場合、本ソフトウェアの複製およびその構成部分をすべて破棄しなければなりません。また、当該違反により乙に損害が発生した場合、乙は甲に対し損害賠償請求をすることができます。
  3. (3)甲は、本条第1項により契約が終了した以降は、本ソフトウェアを一切使用できないものとします。
第12条 (準拠法))

本契約書の成立、効力、解釈および履行については、日本国の法律に準拠するものとします。

第13条 (裁判管轄)

本契約書の内容に関する一切の紛争に関して訴訟を提起するときは、東京地方裁判所または東京簡易裁判所を第一審の専属的合意管轄裁判所といたします。

第14条 (完全な合意)

本契約書(本ソフトウェアに付属する本契約書の修正または追加条項を含みます)は、本ソフトウェアおよびサポートサービス(該当する場合)に関して甲と乙の間の完全な合意を構成し、本ソフトウェアまたは本契約書で扱われているその他の主題に関するすべての以前および同時の口頭または書面による意思表示、提案、および表明を無効にします。

  ICU uses the public domain data and code derived from Time Zone
Database for its time zone support. The ownership of the TZ database
is explained in BCP 175: Procedure for Maintaining the Time Zone
